Notice on the Consumer's Right of Withdrawal

pursuant to Article 49, paragraph 4 of Legislative Decree 206/2005 and subsequent amendments (Italian Consumer Code)

I) Who is the Consumer?

The natural person who acts for purposes unrelated to their entrepreneurial, commercial, artisanal, or professional activity, if any, is defined as a "consumer," with the consequences and rights provided by the Italian Consumer Code. Welcome to https://www.kareitaly.com/en/, our e-commerce site!

II) What is the Consumer's Right of Withdrawal?

Are you not convinced about what you purchased on our Website? No problem: the right of withdrawal is your right to reconsider the purchase you have already made. Within 14 days, you can inform us of your decision to exercise the withdrawal, renounce the purchased products, and receive a full refund of the price paid without having to provide any reason and without incurring any additional costs, except in specific cases indicated later (see Chapter V).

However, the right of withdrawal CANNOT be exercised for the supply of sealed goods that are not suitable for return for hygiene or health protection reasons and have been unsealed after delivery.

III) What Happens if You Exercise the Right of Withdrawal?

Once we are informed of your decision to withdraw, all related payments made to us will be refunded without undue delay and no later than 14 days from the receipt of your communication. Refunds will be made using the same payment method you used for the initial transaction (e.g., PayPal and credit card) unless you expressly agree otherwise.

IV) How to Exercise the Right of Withdrawal

It is straightforward; you need to inform us of your decision to withdraw.

Once the form is completed and sent, we will confirm receipt of the communication at your email address.

V) Which Costs Cannot Be Refunded?

The Italian Consumer Code stipulates that supplementary delivery costs are excluded from the refund. Our Website specifies the delivery solution for the purchased products ("standard delivery max. 3-5 days"). If you choose a delivery method different from our solution, those supplementary delivery costs will not be refunded in the event of withdrawal.

VI) Return Methods for Items Delivered to the Consumer

The return method chosen by our company is:

  • Collection from the consumer's address at the seller's expense.
  • Postal shipment at the consumer's expense.
  • Postal shipment at the seller's expense.

These are the three solutions that, in general, the Italian Consumer Code provides for when the consumer exercises the right of withdrawal after the goods have been delivered.

The solution we have chosen to adopt for the return of our products is collection from the consumer's address at the seller's expense with the specified methods above (see Chapter IV).

VII) For Which Contracts Does the Italian Consumer Code Provide the Right of Withdrawal?

  1. Service Contracts: Contracts where the consumer purchases a service or performance.
  2. Single Item Purchase Contract: Contract for the purchase of a single item.
  3. Multiple Items or Lots Purchase Contract: Contract for the purchase of multiple items or quantities of the same item.
  4. Contract for Periodic Delivery of Goods for a Fixed Period: Periodic delivery means that the delivery is made according to a regular schedule decided in the contract (e.g., "every five days," "every 1st of the month," etc.).
  5. Supply Contract: When the seller supplies a certain good (e.g., electricity, gas, water, telephone line) for the entire duration of the contract in a quantity generally determined by the needs (consumption) of the buyer.

VIII) Can the Right of Withdrawal Be Exercised for Any Item?

Article 59 of the Italian Consumer Code lists goods and services for which the right of withdrawal cannot be exercised after purchase. Don't worry! If you purchase one of those products, you will be informed at the time of purchase that the right of withdrawal cannot be exercised.

IX) What Is the Difference Between "Withdrawal" and "Return"?

Clarity is important to us! Sometimes these two terms are used interchangeably; however, only withdrawal unmistakably refers to the consumer's right to reconsider their purchase, and it is explicitly regulated as such by the Italian Consumer Code, with the characteristics and effects we have described.

The term "return," on the other hand, does not have a specific definition in the Italian Consumer Code but is often used in reference to the return of defective goods under the "legal guarantees" and "commercial warranties" provided for the consumer.
